Cost of skipping it? $400,000. A college degree. A family.

𝗪𝗵𝗮𝘁 𝗬𝗼𝘂𝗿 𝗧𝗿𝘂𝘀𝘁 𝗖𝗮𝗻 𝗜𝗻𝗰𝗹𝘂𝗱𝗲:

→ Staggered distribution ages (not just 18 or 21)
→ Milestone-based releases (education, home, business)
→ Discretionary trustee powers for emergencies
→ Spendthrift provisions preventing creditors and bad decisions
→ Incentive clauses rewarding responsibility

A couple of years ago, I worked with a client who was the "Gallant" to this 19-year old's "Goofus" (Highlights magazine anyone?!?)

My client inherited millions at age 18 through his father's insurance policy. His first move? Talking to his financial advisor, who recommended he talk to me and set up a trust to help manage the money. 

We got it all set up and funded before he started college in the fall, and he's now got a system in place to protect that insurance money.

Because the most expensive trust provision isn't the one you add.

It's the one you leave out.

Because a 19-year-old with $400,000 isn't inheriting wealth.

They're inheriting a test they haven't studied for.

And most of them fail.

• Ventilator decisions? Documented.
• Feeding tube preferences? Clear.
• Pain management vs. consciousness? Your call, not theirs.
• Resuscitation wishes? In writing.

𝗪𝗵𝗮𝘁 𝗛𝗮𝗽𝗽𝗲𝗻𝘀 𝗪𝗶𝘁𝗵𝗼𝘂𝘁 𝗢𝗻𝗲:

Your family fights in hospital hallways. Doctors make decisions based on liability, not your values. Courts get involved. Lawyers bill by the hour while you're on life support.

The people who love you most become adversaries.

𝗧𝗵𝗲 𝟯𝟬-𝗠𝗶𝗻𝘂𝘁𝗲 𝗙𝗶𝘅:

1. Get a living will (also called an advance directive)
2. Name a healthcare proxy who actually knows your wishes
3. Have the uncomfortable conversation with them
4. Give copies to your doctor, your proxy, and your family

The most expensive healthcare decision isn't the treatment.

It's the family relationship destroyed because nobody knew what you wanted.

Your regular will distributes your stuff.

Your living will protects your dignity.

And your family's sanity.

Your family structure isn't destiny. But it is a warning sign.

Here's what happens when you pass away without a plan for your pets:

Nobody was asked. Nobody was prepared. Nobody knows what food they eat or which vet they see.

Whoever grabbed your pet "temporarily" is now stuck. They didn't sign up for this. They can't afford the vet bills. They don't have time for daily walks.

The "temporary" solution becomes permanent neglect.

Or worse: a one-way trip to the shelter.

→ Pets end up with people who aren't equipped to care for them
→ Diet, medical needs, and routines get ignored
→ Senior pets with special needs? Almost impossible to rehome
→ Your 12-year-old golden retriever could spend his final months in a concrete kennel

You wouldn't leave your kids' future to chance. Your pets deserve the same consideration.

A pet trust takes about 15 minutes to discuss with your attorney. It names a caregiver. It funds their care. It gives instructions.

Your pet can't advocate for themselves. That's your job.

And that job doesn't end when you're gone.

Brendan McElroy asked this at our INC Group meeting last week. He works in HR consulting for M&A transactions, and he had a story that had us all perk our ears up.

A company with 50 employees is about to take private equity investment. They've got lawyers. They've got accountants. They've got the term sheet ready.

What they don't have? A plan for payroll.

Brendan put it bluntly: They just thought about filling their bank accounts with a few more digits after the transaction. But the investors are planning on doing something with the business afterwards.

People go to work. People expect to get paid. Sounds obvious. But when you're focused on the deal itself, the operational stuff gets pushed to "we'll figure it out later."

𝗪𝗵𝗮𝘁 𝗚𝗲𝘁𝘀 𝗠𝗶𝘀𝘀𝗲𝗱 𝗪𝗵𝗲𝗻 𝗛𝗥 𝗜𝘀 𝗮𝗻 𝗔𝗳𝘁𝗲𝗿𝘁𝗵𝗼𝘂𝗴𝗵𝘁:

→ Payroll systems that don't transfer cleanly
→ Employee files missing basic documentation
→ I-9s that haven't been audited in years
→ Tech stacks that can't scale from 50 to 300 employees
→ The "synergies" everyone imagined that never materialize

His firm checks 165 different items in its human capital diligence. Most companies preparing for a transaction haven't thought about half of them.

The deal closes. The champagne gets popped. And then Monday morning hits.

Who's running payroll? Who has access to the systems? Who's actually staying?

The companies that plan for this? Smooth transition.

The ones that don't? They're calling Brendan six months later, asking why nothing works.

It's the part that determines whether the deal actually works.

Folk songs evolve because there's no plan. No instructions. No structure to preserve the original intent.

𝘋𝘰𝘤𝘶𝘮𝘦𝘯𝘵 𝘊𝘰𝘭𝘭𝘦𝘤𝘵𝘰𝘳: "Your LLC is filed."
𝘋𝘪𝘴𝘢𝘴𝘵𝘦𝘳 𝘗𝘳𝘦𝘷𝘦𝘯𝘵𝘦𝘳: "Your LLC is filed. Now let's talk about the banking resolution, the corporate formalities, and what happens when a customer sues and their attorney tries to pierce the veil."

𝘋𝘰𝘤𝘶𝘮𝘦𝘯𝘵 𝘊𝘰𝘭𝘭𝘦𝘤𝘵𝘰𝘳: "Your contract looks fine."
𝘋𝘪𝘴𝘢𝘴𝘵𝘦𝘳 𝘗𝘳𝘦𝘷𝘦𝘯𝘵𝘦𝘳: "Your contract caps liability at $50K, but your insurance deductible is $100K. You've guaranteed you'll pay the first $50K of any claim out of pocket."

𝗧𝗵𝗲 𝗤𝘂𝗲𝘀𝘁𝗶𝗼𝗻𝘀 𝗗𝗶𝘀𝗮𝘀𝘁𝗲𝗿 𝗣𝗿𝗲𝘃𝗲𝗻𝘁𝗲𝗿𝘀 𝗔𝘀𝗸:

• Who can sign on your accounts if you're incapacitated tomorrow?
• What happens to payroll if you can't access the bank on Monday morning?
• Does your buy-sell agreement actually have funding behind it?
• Are your beneficiary designations current or still listing your ex?
• Can your family keep the business running or just inherit a mess?

Templates don't ask these questions. They can't. They don't know your business. Your family. Your partners. Your actual risks.

Protection is buying a bulletproof vest.

Prevention is making sure it fits, checking it regularly, and knowing when to wear it.

Most business owners have protection sitting in a drawer somewhere.

Very few have prevention built into how they operate.

Find the advisor who thinks through scenarios, not just paperwork.

Because the cheapest legal work is the disaster that never happens.
