I began my year with reflection, not resolution.

At a reflective learning session with SettleWiseNow, the conversation was anchored by insights shared by Soni Singh — an experienced mediator whose practice-led reflections sparked a rich, honest exchange. What followed was not a lecture, but a learning circle: questions, additions, disagreements, and shared realities from those of us in the room.

What stood out for me was this:
mediation doesn’t lose momentum because parties resist resolution—
it loses momentum when they don’t truly understand the process.

In pre-litigation and court-annexed mediation, parties often agree to participate because the law suggests it or the court nudges them there. But agreement is not the same as readiness.

That gap is where the mediator’s role becomes critical—not as an authority, but as a facilitator of clarity.

Some reflections that stayed with me:
>> Pre-counselling is not a formality; it is foundational to trust and engagement.
>> Many parties disengage because mediation feels “non-adjudicatory” and therefore optional.
>> Lawyers may hesitate—not out of resistance, but because the system rarely rewards patience.
>> An opening statement, when used well, can shift scepticism into participation.
>> Mediation is not about power or persuasion—it is about conversation and safe spaces.

As mediators, our work often begins long before the joint session:
explaining confidentiality, setting expectations, and helping parties understand why they are here.

These sessions remind me why collective reflection matters—because mediation practice deepens when experience is shared and meaning is co-created.

Grateful to #SettleWiseNow for holding space for learning that is honest, reflective, and rooted in practice.
