For over fifteen years, I've defended hundreds of clients and earned millions in fees for criminal defense cases.

We sometimes say lawyers suffer from “compassion fatigue.”

But what if compassion isn’t the problem? What if it’s the solution?

My sister is a social worker. Social workers often struggle with stress and burnout. But she recently taught me something that is changing my practice: 

Compassion isn’t fatiguing. It’s energizing.

Fake compassion is fatiguing.

It’s exhausting pretending to laugh at your boss’s jokes. It’s taxing to pretend that your client is an angel when they’re stealing and lying and hurting people. But genuine compassion — actually seeing someone for who they really are, strengths and flaws together — that’s energizing. That’s connecting.

If you fake compassion, it will exhaust you. It will make you feel like a used car salesman. Don’t fake it.

Look for real gifts and real strengths in your clients. It takes effort. During new client consultations, I have to use a checklist to remind myself to stop and look for my client’s good qualities before I jump into problem-solving mode.

Genuine compassion will energize your practice and attract great clients.

Compassion isn’t the problem. It’s the solution.

When I tell other criminal defense lawyers that basically ALL my clients have my cell phone number, they're shocked. In fact, it was the best thing I ever did for my practice.

Giving clients your cell phone seems scary. You imagine calls at midnight, texts on weekends, no boundaries.

The opposite happened.

- I actually get FEWER calls now. 
- Our satisfaction scores went way UP.

Here's what I figured out: clients weren't usually calling with questions. They were testing the channel between me and them.

What they really needed was the comfort of knowing — if there's an emergency, I can get a hold of Josh. That mattered more to them than whatever question they were asking.

Before, they'd call my paralegal. My paralegal would email me. I'd say, 'that's a dumb question, tell them this.' My paralegal would call back with a terse answer.

But the client wouldn't feel better. Because the real question wasn't answered. The real question was: can I reach you when I need to?

Now they text me directly. I respond a couple times early in the case. And then something shifts. The number of texts and calls goes way down.

They're not testing anymore. They know they can reach me. So they stop needing to check.

I was surprised to find that access didn't increase calls. It reduces them.

Our Net Promoter Score went way up after we made this change too. Clients felt taken care of — because they knew we were reachable.

You still need boundaries. I don't respond after hours. There are automatic messages saying so. But giving access and setting limits aren't opposites. You can do both.

Show your clients that there is someone for them on the other end. You'll be surprised.

50 referral relationships are more than enough to fill your criminal defense practice. Here's an exercise to get to 50:

1 - First, start with people who have already sent you referrals. If someone's sent you one, they're way more likely to send you another. This is your warmest list. If you can get to 50 with just this group, you're done.

2 - Second, search your calendar for the word "lunch." Anyone you've had a meal with in the last year or two is a candidate. You already have a relationship. You've already invested time in each other.

3 - Third, think about law school classmates who practice in your area. Even if you haven't talked in years. You have shared context. It's an easy conversation to restart.

4 - Fourth, people you've worked with in the past — even if they're not lawyers. Old colleagues, former bosses, people from other jobs. They know you. They trust you. They might know someone who needs a criminal defense attorney.

5 - Fifth, just proximity. Lawyers in your building. Lawyers who live near you. The attorney you see at school pickup. Sometimes the easiest referral relationship is with someone you already run into.

That's the order I'd do it in. Most warm to least warm.

The "50" number helped me because "build a referral network" is vague. It sounds important but it doesn't tell you what to actually do. It doesn't tell you when you're done.

Fifty names is specific. It's a list you can write down. And once you have it, you can start asking, "When's the last time I reached out to each of these people? Who haven't I talked to in a while?"

It turns the abstract task of "networking" into individual people and concrete steps you can take. And concrete is way easier to act on.

We did this exercise with our leadership team where everyone shares one strength and one weakness about each person on the team. As someone who hates conflict, I almost bailed.

For context, we use EOS to run our firm. EOS recommends the "one thing" exercise for the annual meeting.

As we were starting the meeting, I was going through the agenda, and I saw the "one thing" exercise coming. I thought: 'I'm not going to do it. I'm going to skip it.'

And then I just... didn't skip it. I explained the exercise, everyone got a piece of paper, and we did it.

The strengths were nice. I honestly can't remember what my team said about my strengths.

I remember the weaknesses instantly.

One team member said I'm moody.

I'm not going to lie, it hurt my feelings. 

And I asked him: can you give me a specific example?

He said: "When I call you, I don't know if you're going to be excited that I called or bugged that I called."

And I was like... yeah. That's true.

What he was noticing is that if he caught me in the middle of a thought, I don't like being interrupted. I'm focused, I'm excited about what I'm doing, and then the phone rings and I have to switch. I don't hide my frustration well.

So we came up with a fix. We now have a standing call every day at 11am. If he has something to discuss, he calls. If he doesn't, he just doesn't call — he doesn't cancel the meeting or anything, he just doesn't call. 

It's such a simple thing. But I never would have done it if he hadn't told me the truth.

I'd appeared moody for years. He'd been dealing with it for years. Neither of us said anything.

One uncomfortable conversation, and now we have a system that works for both of us.

I think that's the thing about feedback or conflict that stings — it usually points to something fixable. Not always. But often enough that it's worth sitting with instead of getting defensive.

I'll remember those weaknesses for a long time. And I'm better for it.

I used to think I was bad at managing people. Then I realized: maybe I just don't want to manage people? Those are two very different problems.

At one point we had 11 or 12 employees. All of them reported to me. And I wasn't managing them.

I'd plan my week. I'd block off time for check-ins, training, one-on-ones. And then client issues would come up. Case stuff would come up. And I'd always prioritize that case work over managing a team member.

For a long time I was really frustrated with myself. I kept trying to psych myself into it. You've got to manage these people! You've got to do better!

Eventually I stopped judging and started getting curious.

The way I was spending my time was telling me something about how I wanted to spend my time. I just didn't want to do it.

11 people is way too many for most people to manage. And especially for me. I think I can manage two people pretty effectively. More than that, it's hard.

So we downsized. 

Now we're a small team. Four people. Two direct reports. And I actually manage them. Not perfectly, but I do it.

The thing I kept missing was that my calendar was giving me information. I just didn't want to hear it. I wanted to believe I could be the guy who runs a big team, manages 11 people, scales the thing up.

But every week, my actual behavior was telling me: that's not who you are. It was a signal that I needed to pay attention to.

I'm not saying everyone should downsize. Maybe you actually do want to manage a big team and you just need better systems.

But for me, the answer was to admit I didn't want what I thought I wanted.

That's an uncomfortable thing to realize about yourself. But it's a lot more useful than beating yourself up for years.
