Volim da kažem preduzetnicima koji pružaju usluge, pogotovo onima koji imaju puno sitnih potraživanja za koje im se ne isplate da pokreću parnice, da koriste menice u ugovornim odnosima.

Evo npr. u praksi često viđam transportere za veće firme koji se muče da naplate svoju uslugu - prevoz, dnevnicu za vozača, refundaciju goriva, i sve ostalo - jer ih firme razvlače po 40-90 dana za isplatu (a neretko isplate ni ne bude).

Bukvalno, bude ono klasično: "Samo još par dana…poslao sam knjogovođi, u proceduri je…e, šaljemo uskoro, izvini, nešto je iskrslo…”, a oni su već isporučili sve što su imali da isporuče.

E, pa menica, recimo, tu neretko izvuče situaciju.

Klijent lepo na početku saradnje potpiše menicu, primera radi, na 300.000 RSD kao "kreditni limit", i taj novac naplaćujete od njega prinudnim putem SAMO u slučaju kašnjenja u isplati, jer vam menica služi kao neki sigurnosni mehanizam.

Nema dvomesečnog dopisivanja, 5 opomena, back-and-forth "je l' ti stigla faktura/legla uplata" poruka, pravdanja i najvažnije od svega, nema 20 sporova mesečno oko svake uplate, sa svakim partnerom.

Kod menice je naplata ubrzana, pa čak i kad dužnik uloži prigovor, postupak ide dalje. Isto tako, iz nekog našeg iskustva, ljudi su skloniji da uplate svoj dug kada znaju da imate u rukama nešto što se brzo sprovodi. 

Prosto, menica vas stavlja u kategoriju "ne isplati se da te zavlačim".

Jedino što treba voditi dobrog računa prilikom potpisivanja menice i meničnog ovlašenja, i imati u vidu sve specifičnosti sudskog postupka prinudne naplate menice, jer ima tu podosta nekih začkoljica, ali...
