As a fractional CFO I use the 10+ years I spent working IN a law firm to help law firm owners gain an in-depth understanding of their firm’s financial picture. 

I am on a mission to help law firm owners become confident in their law firm finances. When firm owners have big financial goals, the first step to reaching those goals is making strategic financial decisions.

I started as a legal assistant and worked my way up through the “law firm ranks”. I know how a law firm runs day to day. When you hire me as your fCFO I bring my financial expertise and my law firm operational experience to our meetings. 

I love working with law firms because they are unique in the small business world. Revenue can be a roller coaster and expenses are unique to law firms. 

I work with law firm owners who are in all different growth phases. This includes.

•	Firms who are hiring their first employees and making the jump from a true solo firm to a firm that has growth in their future. 
•	Firms that are pushing towards their first 7-figure year, hiring associates, and taking their expenses to the next level.

Marting Law, LLC attorney Richelle Marting JD, MHSA,RHIA,CPC,CEMC,CPMA spoke to hundreds of managed care contracting executives this week at the Florida Hospital Association's Managed Care Contracting Conference this week on Trending Issues in Managed Care Contracting.

▶️ "Failing to pay out money owed based on a false statement of reasons for denying is cheating." ◀️ 

We often find ourselves frustrated by a shape-shifting denial process. We tackle one erroneous basis for denial after another, but new reasons seem to pop up at every turn. I guess we're not alone.

This 'denial shift' was examined by the 9th Circuit in Salomaa v. Honda Long Term Disability Plan, and the court explained "[t]he plan's reasons for denial shifted, as old reasons, proved erroneous, were replaced by new ones." It continued "[t]he plan's reasons for denial were shifting and inconsistent as well as illogical", and sharply noted that ▶️ "Failing to pay out money owed based on a false statement of reasons for denying is cheating, every bit as much as making a false claim." ◀️ 

It didn't stop there. "The continual shifting of the plan's grounds for denial also suggest abuse of discretion."

It's a great case, worth a read, because the rules upon which it is based fall under the same regulations as ERISA's rules governing group health plans.

Here's one to follow and escalate to your own State Representatives to encourage support. Federal House Bill 5454 forces MA plans to pay interest on clean claims, shortens the prompt payment period, and gives much needed technical clarity to the definition of a clean claim.

House Representatives Sanchez (D-CA); Veasey (D-TX); Miller (R-WV) introduce a bipartisan Medicare Advantage Prompt Pay Act bill. It would:
✔️ Require MAO/CMS contracts to pay clean claims within 14 days for electronic claims
✔️ Provided much-needed technical clarity on what constitutes a clean claim: "a complete data set, with respect to the UB–04 or CMS 1500 form, as applicable (or successor to such applicable form), for all entries identified as mandatory entries by the National Uniform Billing Committee"
✅ Creates a rebuttable presumption that a claim is clean. This shifts the burden to the plan to prove the claim is incomplete (based on federal claim form rules)
✅ Forces payment of interest by MA plans on clean claims not paid timely
✅ Creates a penalty against the plan of $25,000 "for each such determination". This would be a civil penalty, not a penalty issued to the provider
