International Organization of Securities Commissions - IOSCO’s - DeFi Recommendations

1️⃣  Same Activity, Same Risk, Same Regulation
- IOSCO’s message is clear: DeFi should meet the same regulatory outcomes as traditional finance — but it can deliver far greater transparency and automation. 

2️⃣ Clear Accountability Still Matters
- Even decentralised systems have people and entities who influence governance and parameters. 

3️⃣ Judge DeFi by Its Function, Not Its Labels
- IOSCO urges regulators to analyse economic reality.
- Aave Horizon is a strong example: institutional, permissioned, transparent — and still fully on-chain.

4️⃣ Strong Risk Management Is the Differentiator
- DeFi faces real risks: exploits, governance complexity, leverage, oracles, and cross-chain interlinkages.

5️⃣ Compliance Gateways Will Win
- DeFi is global.  IOSCO calls for enhanced cooperation between jurisdictions to prevent regulatory arbitrage and harmonise enforcement approaches.
- Push — Aave Labs’ CBI CASP-authorised, MiCAR-ready on/off-ramp — provides the regulated fiat bridge that institutions expect.

Real-World Example 
- During the 2022 market chaos, when centralised platforms froze withdrawals, Aave stayed live and solvent.
- Every liquidation, parameter change, and exposure was visible in real time on-chain — giving users and institutions clarity that traditional platforms simply could not provide.

Why It Matters
- Regulators are no longer evaluating DeFi theoretically — they’re operationalising it. 
- This report is now the closest thing to a global regulatory blueprint for DeFi and will influence the EU, UK, APAC, and US approaches.
- For builders, investors, and institutional entrants, this sets clearer expectations around disclosure, governance, risk management, and accountability.
 
What Happens Next
- National regulators begin integrating IOSCO’s recommendations into their frameworks.
- Expect increasing scrutiny on governance structures, Responsible Persons, cross-chain infrastructure, and stablecoin dependencies.
- DeFi protocols and service providers will need to align with traditional financial outcomes: transparency, investor protection, and market integrity.
- Institutions entering DeFi will prioritise partners who can demonstrate compliance-by-design.

European Central Bank's, former director general of market infrastructure and payments, Ulrich Bindseil, - "The One Point All Regulators Agree On: Stablecoins Must NOT Be Remunerated".

Across the EU (MiCAR), US (Genius Act) and UK, there is one striking consensus: stablecoin holders must not receive interest.But why?

The stated rationale is financial stability. Regulators fear that if stablecoins paid interest, deposits would flow out of banks — especially in moments of stress — accelerating disintermediation.

The ECB frames this as a way to prevent bank runs and manage liquidity risk.
But this creates an “original sin”:

Stablecoins become structurally uncompetitive versus money market funds, tokenised T-bills and high-yield digital savings — pushing activity into the shadows instead of regulating it.

The Better Question: What Are the Alternatives?
The paper itself outlines multiple regulatory tools that could preserve financial stability without freezing innovation. Here are the most credible options:

1️⃣ Capital + Liquidity Requirements
- Just like banks and MMFs, stablecoin issuers can hold:short-term T-bills,
central bank deposits, segregated liquidity buffers.
- These tools already control run risk without banning yield. 

2️⃣ Reserve Quality Rules
- Mandating high-quality, short-duration assets (e.g., <93-day T-bills in the US) delivers stability without touching remuneration.

3️⃣ Access to Central Bank Infrastructure
- The Bank of England is exploring models where stablecoins hold 100% reserves at the central bank, with clear operational rules.
- This solves liquidity risk at source — no need for a remuneration ban.

4️⃣ Limits on Concentration, Not Income
- Instead of capping yield, regulators can cap: single-bank exposure,
maturity buckets, systemic concentration. These directly target systemic risk, not returns.

5️⃣ Strengthening Bank Regulation (Not Weakening Stablecoins)
- The paper notes that deposit runs today are not just about stablecoins — switching costs across all money forms have collapsed.
- Improving bank resilience is a more coherent long-term solution than forcing stablecoins to be “zero-yield forever.” 

Why It Matters
- The prohibition on stablecoin remuneration is not a law of nature — it’s a policy choice, and one that risks distorting markets.
- Stablecoins are 24/7, programmable, globally accessible digital money. If designed correctly, they can complement banks, not replace them.
- A regulatory model that uses capital, liquidity, transparency and real-time oversight is more sustainable than a blanket ban on yield.

What Happens Next
- Expect growing debate — especially as tokenised money market funds and on-chain T-bills offer 5%+ while regulated stablecoins are forced to offer 0%.
- The gap is becoming too large to ignore.
- There are better ways to regulate stablecoins and the paper shows the blueprint is already there.
