One stat from Clio’s new report jumped out at me:

86% of mid-sized law firms have adopted AI, but only 39% are seeing revenue gains from it.

That gap is telling. Adopting AI is one thing. Capturing the value from it is another.

As the report puts it:

“As AI compresses hours into minutes, firms that adopt AI more widely are rethinking traditional billing. Many are shifting toward flat fees that capture the value of expertise, not just time. The result: higher margins for firms and more predictable costs for clients."

As AI makes lawyers faster, the billable hour can actually reduce revenue from those efficiency gains.

Firms that pair AI with modern pricing models will be the ones that truly benefit.

Will AI Mean the Death of the Billable Hour in Legal?

One quiet problem with the traditional hourly model: you don’t have to define the matter.

When work begins after hourly rates have been agreed to, there’s no structural requirement to clearly define:
▸ What’s included
▸ What’s not
▸ Where one phase ends and another begins

The meter just runs ⏱️ 

That flexibility sounds efficient, but it creates ambiguity. Scope becomes subjective.  “Success” or “done” becomes a debate instead of a definition. Misalignment with clients becomes almost inevitable.

Firms using flat, staged, or value-based pricing don’t have that luxury. They’re forced to define:
🔹 Scope
🔹 Assumptions
🔹 Complexity factors
🔹 Boundaries
🔹 What success looks like

That discipline doesn’t just protect margin — it creates clarity & alignment.

Pricing structure shapes behaviour more than we think. And the hourly model shapes it quietly.

Value-based pricing is the counter to the pricing pressure created by AI-driven efficiency gains.

🟧  What does that mean?

Under the hourly model, efficiency actually reduces revenue. The faster the work gets done, the fewer hours there are to bill. We’ve connected those dots for a while now.

🟧  So what do we do?

We need to incorporate non-time-based considerations so pricing is tied to outcomes, judgment, risk, and impact — collectively the value of the offering, not just time spent.

This is the first of a few posts focused on non-time-based pricing considerations. In a world of AI-driven efficiency, the topic is more important than ever!

Not all non-time-based pricing considerations are the same.

I tend to think of them as two sub-categories under non-time-based considerations — meaning factors that don’t necessarily affect how long the project will take.

1️⃣  Value-based factors (client-facing): pricing based on the client’s perceived value of the service.
👉 Examples: urgency, amount at stake, business impact, or regulatory risk.

2️⃣  Internal drivers (firm-facing): pricing based on the firm’s capabilities, constraints, and strategic priorities.
👉 Examples: strategic benefits, capacity constraints or strength of client relationship.

Both matter. Value-based factors help firms price around the client’s outcome. Internal drivers ensure pricing reflects the realities of a firm’s priorities and constraints.

Together they move pricing away from solely time focused towards a more structured, value-oriented model.

One thing that’s interesting about value-based pricing is that it makes "discounting" more intentional.

Under the hourly model discounts often happen after the fact, when the work is done.

A client receives an invoice. There’s pushback. Time gets written off.

That’s not really pricing strategy, it’s damage control.

When firms structure pricing around value, they can also adjust pricing to be lower upfront.

For example, firms might reduce pricing based on factors like:

 🔶 Long-standing client relationships
 🔶 Lower financial stakes in the matter
 🔶 Non-profit organizations
 🔶 Household income

Instead of writing off time later, the firm makes a deliberate pricing decision from the start. Value-based pricing doesn't just allow discounting, it enables firms to 
systematize their approach across the firm.

Pricing structure shapes behaviour more than we think.
