We stood firm when HMRC opened a compliance check on an R&D tax relief claim we advised on for the 2018/19 financial year. We believed in our client’s qualifying R&D projects and encouraged them to keep claiming.
As a result, HMRC expanded its review, eventually scrutinizing the next three years of claims. We now had £897k in corporation tax savings on the line. Their R&D Compliance Team refused all the claims initially, but we didn’t back down. We escalated the case to the HMRC Solicitors Office & Legal Services (SOLS).

💥 Today, justice prevailed. SOLS ruled in our client’s favour! ✅

𝗛𝗠𝗥𝗖 𝗶𝘀𝘀𝘂𝗶𝗻𝗴 𝟭𝟱% 𝘁𝗼 𝟯𝟬% 𝗽𝗲𝗻𝗮𝗹𝘁𝗶𝗲𝘀 𝗼𝗻 𝗥&𝗗 𝘁𝗮𝘅 𝗰𝗹𝗮𝗶𝗺𝘀 and this time they are justified!

I was recently contacted by a large, well-established business that was in the middle of an HMRC compliance check. The advice they received from a so-called R&D tax consultancy practice was shocking. 

They had claimed over £1.5m of R&D expenditure, but the reality is that the claim is around 20% of this figure.  

𝗞𝗲𝘆 𝗲𝗿𝗿𝗼𝗿𝘀:
1. Only one out of the four projects qualified.
2. The R&D consultant estimated staff percentage times (without discussion with the claimant or sight of any records)
3. The R&D consultant used a % of the cost of sales to estimate consumable costs and claimed around £800k. The reality is that they had minimal consumable costs.

𝗧𝗵𝗲 𝗥&𝗗 𝘁𝗮𝘅 𝗰𝗼𝗻𝘀𝘂𝗹𝘁𝗮𝗻𝗰𝘆 𝗶𝗻𝗱𝘂𝘀𝘁𝗿𝘆 𝗺𝘂𝘀𝘁 𝗯𝗲𝗰𝗼𝗺𝗲 𝗿𝗲𝗴𝘂𝗹𝗮𝘁𝗲𝗱
Simply registering with HMRC to be a tax agent is not good enough. We need regulation on two levels:

1. R&D tax agent to be registered with a recognised accountancy or tax professional body (Tax and AML compliance)
2. R&D tax agent's technical analysts must be registered with a recognised industry body relating to their domain expertise

This will swing the dial towards prevention rather than cure and save huge amounts of taxpayer money.
