Your 401(k) could soon be buying the building you work in.

Trump’s new order cracks open about $12T in retirement cash for alternative assets, including private real estate.

On August 7, 2025, the White House signed EO 14330, “Democratizing Access to Alternative Assets for 401(k) Investors.” 

It directs the Department of Labor and nudges the SEC to make it easier for 401(k)s to hold alternatives such as private real estate, private credit, infrastructure, and digital assets, with draft guidance and potential safe harbors due in roughly 180 days.

A new buyer enters the chat. 

If recordkeepers slot alternatives into target date funds and collective investment trusts, we could see durable flows into non traded REITs, core and core plus funds, and private credit that finances development. 

That is long dated, sticky capital that real estate loves.

Pricing could firm up in the right places. 

Persistent inflows would likely compress cap rates first in core and stabilized assets. 

Secondary markets and development may benefit next through cheaper mezzanine and private credit. 

Directionally this tracks with flows and valuations, but execution will depend on plan menu design and fiduciary comfort.

Products will evolve. 

Expect 401(k) friendly wrappers such as CITs, interval funds, and hybrid sleeves that solve for liquidity, fees, and transparency while still providing private market exposure. 

Sponsors that partner early with recordkeepers will win distribution.

Fiduciary chill is thawing, slowly. 

The Department of Labor already rescinded a 2021 statement that discouraged private equity and alternatives in defined contribution plans.

Adoption will still take time. Committees will continue to vet fees, valuation, and liquidity. 

Litigation risk will not vanish, but the playbook is getting clearer.

Who stands to gain. 

Institutional managers with real estate platforms, developers who can tap private credit sleeves, and sponsors able to deliver education and quarterly transparency in 401(k) wrappers.

Who does not. 

High fee and opaque strategies without robust reporting or liquidity management.

What to watch in the next six to twelve months. 

First, DOL and SEC guidance and any safe harbor for offering alternatives in QDIAs and target date funds. 

Second, large providers such as Fidelity and Vanguard piloting alternative sleeves. 

Third, recordkeeper integrations for non traded REITs and real asset CITs. 

Fourth, early plan menu case studies from mega plans.

If you build, buy, or finance assets, start the work now. 

Map products to plan menu needs, tighten reporting, and line up a 401(k) ready education package for committees. 

The next cycle of patient capital may come from your future tenants paychecks.
