It is against the laws of war for armed fighters to embed with aid workers for exactly this reason—because doing so predictably leads to misidentification and dangerous crossfire (see here: https://lnkd.in/e8TcfuwN). 

Yet this appears to be precisely what Hamas did in the lead-up to the WCK incident: “The investigation found that the forces identified a gunman on one of the aid trucks, following which they identified an additional gunman. After the vehicles left the warehouse where the aid had been unloaded, one of the commanders mistakenly assumed that the gunmen were located inside the accompanying vehicles and that these were Hamas terrorists.”

As a result, “[t]he forces did not identify the vehicles in question as being associated with WCK. Following a misidentification by the forces, the forces targeted the three WCK vehicles based on the misclassification of the event and misidentification of the vehicles as having Hamas operatives inside them, with the resulting strike leading to the deaths of seven innocent humanitarian aid workers.”

This is a tragedy, and Israel is honorably owning up to and apologizing for it. But the misidentification appears to have been the foreseeable outcome of the convoy’s highjacking by two armed gunmen, presumably from Hamas—which may have been its plan all along.

If so, this is looking like the latest example of a disaster that Israel is immediately blamed for, and that turns out to have been caused, directly or indirectly, by Hamas’s flouting of the laws of war. 

Why isn’t Israel emphasizing this finding more? Perhaps because the incident investigation was conducted by a professional army that is more focused on self-criticism than outward blame, and that holds itself to the highest ethical and legal standards. But those who handle press relations and social media should highlight this investigative conclusion.

Also against the laws of war: the Oct. 7 massacre, the taking of hostages, and their mistreatment in captivity (see Article 3 of the Geneva Convention Relative to the Protection of Civilian Persons in Time of War).

But Hamas does not even pretend or aspire to comply with the Geneva Conventions or any other aspects of international humanitarian law. It proudly breaks them as a matter of strategy. It is not self-critical, except perhaps to beat itself up for not succeeding in killing and brutalizing *more* innocents. And the world shields its eyes and focuses exclusively on Israel.
