The National Star Route Mail Contractors Association

The National Star Route Mail Contractors Association (NSRMCA) is one of the oldest transportation trade associations in operation today. It is the trade association for transportation companies that contract with the United States Postal Service and has been officially recognized by the Postal Service, Congress, Department of Labor, Department of Transportation, and other federal and state agencies. Its members, which operate throughout the United States, collectively manage more than $3 billion in Postal Service contracts and are responsible for the local, regional, and national transportation of the mail.

NSRMCA advocates on behalf of its member companies and a national network of more than 1,500 trucking (and 4,000 final mile) transportation suppliers.

I represented owner-operator truck drivers and small business motor carriers in federal and state court regarding interstate commerce, privacy, worker misclassification, and other regulatory matters. I also served as outside counsel to the Owner-Operator Independent Drivers Association (OOIDA), a national trade association of 160,000 members dedicated to protecting truckers' interests and rights throughout the United States. I provided strategic advice regarding federal and state laws and regulations that impacted the ability of truckers to succeed and represented OOIDA in strategic litigation to protect those interests. I led OOIDA's intervention in the AB5 litigation, challenging California's restrictive independent contractor law, and its initial amicus participation before the Ninth Circuit.

I principally advocated on behalf of commercial clients confronted with onerous, arbitrary, and protectionist regulations throughout the United States in both federal and state courts. I obtained extensive experience at every stage of litigation and client representation, including in leadership positions.

When not litigating in the court of law, I advanced my clients' interests through legislative reform and public policy campaigns. I successfully represented my clients' interest before multiple legislative committees to block adverse proposals and advance favorable legislation.

My work today focuses on the transportation industry, including both non-asset and asset-based companies.

As the Executive Director for the National Star Route Mail Contractors Association (NSRMCA), I am responsible for the operation of the association, its growth and profitability, guiding association members in their relationship with the United States Postal Service, and advocating on behalf of a national network of transportation suppliers to the United States Postal Service (USPS), Congress, federal agencies, and other industry stakeholders. I am also responsible for advising the association on the impact of legal and regulatory developments in the transportation industry.

If you are a shipper, broker, carrier, or municipal employer, there have been significant #DOT and #FMCSA regulatory and enforcement developments in the last 24 hours that could meaningfully impact your business.

Yesterday, at both a U.S. Department of Transportation press conference and in a Fox News interview, Secretary Duffy made clear what most anticipated: the DOT and FMCSA are not stopping at the non-domiciled interim final rule or renewed English language proficiency enforcement initiative to address safety on America's roadways and security of the nation's supply chain.

In addition to the ongoing regulatory and enforcement efforts, DOT will now start scrutinizing #CDL training schools, employers of commercial vehicle drivers, and even shippers, holding each accountable for their respective role in empowering unqualified or unlawful to operate on America's roadways.

While this expanded scope of scrutiny and enforcement efforts will require inter-agency/state coordination and will not happen overnight, shippers, brokers, carriers, and even municipal employers, should take prompt action to protect themselves from liability and government enforcement efforts:

- Shippers and brokers should review their transportation and carrier contracts to ensure that there is specific language addressing driver qualifications and licensing.
- Carriers should implement pre-employment and post-employment processes to inform, educate, and verify drivers about the necessary qualifications. The same goes for onboarding subcontractors/independent contractors.
- The transportation industry should coordinate to identify and verify CDL schools that are providing proper training.

This guidance is even more true for those operating in California, which has received particular scrutiny.
