Silvera Deary Ray

My practice focuses on claims arising from professional wrongdoing and other commercial disputes.   On the plaintiff side, many of my clients suffered losses due to faulty accounting, financial, legal, or other fiduciary advice.  In other cases, I have represented defendants who are alleged to have breached contractual or commercial duties.  I have also represented clients under government investigation.  And I have advised clients involved in high-stakes probate and trust disputes.  

Throughout my career, I have brought or defended numerous negligence, malpractice, fraud, consumer protection, breach of contract, breach of warranty, breach of fiduciary duty, RICO, securities law, and other claims.  Some of these cases have involved petitions to state supreme courts or the Supreme Court of the United States.  In the Georgia Supreme Court, I drafted the briefs that helped secure a reversal on an important statute of limitations question.  In the United States Supreme Court, I drafted briefs supporting and opposing petitions for writs of certiorari.

I began my practice at Jones Day in 2008 before joining the Office of the Texas Attorney General in 2011 to work on high-profile litigation for the State of Texas. While working for the Attorney General, I assisted the state in obtaining an emergency stay from the United States Supreme Court. Prior to law school, I worked as the Chief Financial Officer of the catalog company Wisteria. I joined the predecessor firm to Deary Ray in 2013.

Texas Attorney General

I was on the team that represented Texas on challenges to its redistricting maps and other election laws.  These high-stakes matters resulted in numerous proceedings in federal court in both Texas and Washington, D.C.  They raised important constitutional issues relating to the Equal Protection Clause and federalism.  And they also explored the limits of a federal court's equitable powers to redraw redistricting maps as interim relief when some, but not all, districts in a map were subject to challenge.  The scope of the district court's power to redraw maps ultimately made its way to the Supreme Court of the United States, where I was part of the team that secured emergency relief.

The foregoing election law cases proceeded on extremely tight litigation deadlines. This was because election officials needed sufficient time before an election date to implement the court orders that might affect the next election's administration.  In addition to drafting numerous briefs, taking and defending several depositions, and examining witnesses at trial, I led the document review and privilege log teams in some of these matters.  These teams succeeded in hitting the very compressed, court-ordered deadlines.  

When my service on the election law team came to a conclusion, I joined the Consumer Protection Division of the Office of the Attorney General and created a system for the state to review class action settlements under the Class Action Fairness Act.
