My personal data has been compromised so many times over the last ten years that I’ve lost track...like many people I'm sure.

Those breached companies have paid millions of dollars in settlements to “breach litigators,” and I’ve never seen a penny of it. Although, I did get the promise of 25 cent credit from a parking meter company recently.

So when I read Mary Kopczynski analysis of the recent Holmes v. Elephant Insurance Co. ruling from the Fourth Circuit, I had mixed feelings.

On one hand, I’m glad consumers have a little more power to hold companies accountable. But I worry that the ruling just makes it easier for more lawsuits to move forward. It doesn’t mean companies are automatically going to lose them…or that consumers are going to better compensated for the compromise of their data.

What makes this ruling interesting is the court’s take that if your data shows up on the dark web, that’s enough to count as “public disclosure.” Some practitioners think that goes too far but this seems to be inline with the legal advice I've gotten when managing security incidents in the past. 

Having been on both sides as someone whose data has been exposed and as someone who’s led incident responses...I’m torn. Consumers deserve accountability and to be fairly compensated for their trouble, but this also gives the “breach chasers” a stronger playbook.

The ruling doesn’t change liability yet, but it opens the door for more cases to survive dismissal... and that means higher settlement pressure, higher legal costs, and a higher price for doing business in a digital world that’s already under siege.  

What remains to be seen is if the consumer will get anything more from this...
