"(p.9) Forum shopping by CASPs or issuers creates significant ML/TF risks, which may persist under the new regulatory framework if divergent supervisory approaches continue to apply across jurisdictions. In practice, entities with weak AML/CFT controls have already entered and are operating in the EU market by selecting jurisdictions with lighter supervisory practices or previously lower market entry requirements."

The EU, true to form, has rolled out yet another top-down, suffocating regulation MICA— enormous and completely divorced from any real-world reality — a masterpiece red tape — and then has the nerve to warn about AML risks caused by providers who, shockingly, choose to set up shop in more reasonable jurisdictions and serve Europe via “reverse solicitation.” 

It’s absurd. This AML crusade fails to work and produces wildly disproportionate costs for absolutely nothing. It’s the same logic as those grand plans to “smooth” traffic in major cities — sounds clever in the brochure, until you realize implementation means sticking speed bumps and flowerpots on the roads so fewer cars get through per hour, and voilà, traffic is magically “smoothed” according to their definition. The reality on the ground is that it’s a massive pain in the ass for everyone, costs a fortune, and everything’s jammed, but sure — Brussels will call it “progress.” 

They should really start adding an innovation impact test to every single law. Protecting depositors and investors — fine, that’s legitimate. But it should also be done in the interest of the country and its capacity to innovate. Otherwise, we just end up “protecting” ourselves into irrelevance.

Loïc Staub is a Swiss-qualified lawyer who offers a blend of legal, regulatory, and tech skills to provide strategic guidance to companies seeking to offer financial or blockchain-based services in Switzerland. 

Active in the crypto field since 2016, Loïc has taken part in several projects in decentralized finance (DeFi) a topic that he also teaches at the University of applied science HWZ in Zürich.
