👁️‍🗨️ In de vijfde editie van 2025 van het tijdschrift Privacy & Informatie (Uitgeverij Paris), voorzag ik samen met Yung Shin Van Der Sype de actualiteiten voor België. 

We bespraken de volgende topics:
🏫 Kan een school met een privaatrechtelijk statuut een administratieve boete krijgen? Het Hof van Cassatie | Cour de cassation | Kassationshof stelde een prejudiciële vraag aan het Court of Justice of the European Union. 
🩺 Een arrest van het Grondwettelijk Hof - Cour Constitutionnelle over het inzagerecht in de persoonlijke notities van een gezondheidsbeoefenaar. 
🚲 Een beslissing van de Autorité de protection des données - Gegevensbeschermingsautoriteit (GBA) over het gebruik van een identiteitskaart om een fietsabonnement aan te gaan.
📨 De GBA berispte een Vlaams Parlementslid voor onrechtmatige verkiezingsreclame via e-mail. 
📬Een klassieker, een beslissing van de GBA over de inzage in een professionele mailbox na de beëindiging van de samenwerking.

Het is weer een bijzonder geslaagde editie, maar mijn interesse ging voornamelijk naar het interview van Els Kindt en Yung Shin Van Der Sype met de voorzitter van de Geschillenkamer van de GBA, Hielke Hijmans. De man die er mee voor zorgt dat we bovenstaande rubriek elke editie kunnen vullen. 😅

Should you be allowed to use AI for your own legal defence?

In a recent (unpublished) decision by the Court of Gembloux (Belgium), two defendants without an attorney contested the payment of their architect’s invoice.

🤖 The court noted that "their conclusions were clearly drafted with the active assistance of artificial intelligence" (see the original French extract below). 

It is unclear why the court found it necessary to mention this explicitly, as the use of AI seems irrelevant to this decision. Perhaps it did play a role in how the court assessed the arguments.

🚧 This case makes me question whether AI tools should be obligated to include stronger guardrails against unsupervised use for legal advice. The sycophantic nature of AI is one reason stronger guardrails might be needed, and it also highlights where attorneys can add value. ChatGPT's usage policy already prohibits unsupervised use for providing tailored legal advice that requires a licence, but this is likely not enough. 

However, it seems that prohibiting AI assistance for self-representation altogether might not be beneficial. In The Netherlands a labour migrant won an eviction case with the help of AI and, important distictintion, legal assistance (see the summary by Ljubiša Metikoš: https://lnkd.in/egUTjE_d) 

This leads me to my question, should you be allowed to use AI for your own legal defence?
