What initially appeared to be the work of a “rogue” governor in Wisconsin, showed itself to be a coordinated, and well-funded effort by a new breed of Republicans and their corporate backers.

My Sensory Locations

My Sensory Locations (MSL) was a startup and a tool that aimed at helping the user easily locate a restaurant or location based on their unique sensory needs. We developed a new method to visit a location that was based on the data of the 6 Senses - Sight, Sound, Movement, Touch, Taste & Smell. Our mission was to solve the challenges that individuals with sensory needs encounter within their community. Our goal was to greatly reduce stress and anxiety and ensure that everyone has a great time!

My Responsibilities:

► Oversaw day-to-day marketing activities of new emerging startup

I'm the Principal Creative Director and Co-Founder of Goldstein Media, which is a digital marketing firm in Doylestown, PA, about 20 miles north of Philadelphia.

I design and maintain websites for companies of all sizes. In addition, Web design, I help these companies capitalize on digital marketing. I help these companies with SEO/SEM and strategy.

As if that doesn't keep me busy enough. I'm the Marketing Lead, Board Member, and Advisor at Public Assembly, an amazing startup that combines crowdfunding, crowdsourcing, community management, and user-friendly financial tools to create real change for regular people.

I'm pleased to share the link for an article I wrote for The Legal Intelligencer about how AI terms of service can impact contractual obligations for those asked to create or design works for others.  Thanks to The Legal Intelligencer for publishing the article.

I started thinking about this when a client told me they wanted to use AI to create something and asked if that was allowed under the AI's terms of service.  Another client asked me something similar this week.

Curious to hear what others think about this.  It seems to me that with the increasing use of generative AI, what is in an AI's terms of service is going to become more and more of an important, especially if a work generated by an AI is alleged to be a copyright infringement.

The article is behind a paywall.  Hopefully I will be able to figure something out for those of you without a subscription.

I don't like these AI headshots.



1. They don't show who you really are and show no personality.
2. They could very well be spammers or scammers trying to look legit.
3. They are a neat parlor trick, but they don't even look real. If anything they look like a headshot that was way too touched up and not genuine.

Traditional headshots, done right, show character and who you really are. They can tell a story.

That's why, I only use my headshots that I get from REAL live photographers.

One of my long standing rules for SEO is “Fear Google.” 

In other words, if you do something “for SEO purposes”, they’re going to figure it out and potentially penalize you for it. 

Some examples…

Getting MORE backlinks instead of QUALITY backlinks. 

Writing MORE content instead of GREAT/USEFUL content. 

Keyword stuffing tags…

Keyword focused content…

The list could go on. 

Instead of focusing on SEO for the sake of SEO, focus on creating a great experience for your website visitors and be thorough about what you do. 

In the end, Google will reward you and your visitors will naturally be compelled to reach out.

Congressman Adam Schiff has introduced legislation that, if passed, would amend the Copyright Act and require generative artificial intelligence companies to disclose which copyrighted works were used to train their AI (it applies to existing AI as well as those created in the future). Those who did not comply would face a financial penalty of not less than $5,000. A copy of the text of bill appears below.

Interestingly, the bill calls for disclosure of all works protected by copyright, and not just those works that are registered. This begs the question, though, of how someone is to know a work is protected by copyright—copyright attaches to a work once it is created, not once it is registered (the answer, I suppose, is to assume that everything is protected). Further, the Copyright Office’s current registration database is not the most user friendly, and it does not contain copies of the registered works.

The bill calls for the Copyright Office to establish and maintain a publicly available database containing the disclosures from the AI companies.
A number of creative groups, such as the RIAA, National Music Publishers’ Association, ASCAP, Black Music Action Coalition, Human Artistry Campaign, Professional Photographers of America, SAG-AFTRA, Writers Guild of America, and International Alliance of Theatrical Stage Employees have come out in support of the bill.

It is an interesting first step, but what does the bill accomplish? What happens when the Copyright Office’s database is created? It seems at that point that those whose works have been used might have a basis for filing a copyright infringement lawsuit. If that is the case, what incentive is there for disclosure by AI companies? The financial penalty may not be enough, unless the penalties are significant (it could become the cost of doing business).
Another question. What happens if a creator does not want their work used to train AI? How does disclosure prevent their work from being used?

It is good to see that thought is being given to how to deal with the issue of the unauthorized use of creative works to train generative AI. This is an issue that probably needs a legislative solution (even though there are likely to be judicial solutions before there is a legislative one). My concern here is that this bill will lead to additional litigation.  Unfortunately, I'm not sure how to prevent that.
