Summary

The Truth in Job Advertising & Accountability Act is a comprehensive federal proposal aimed at ending deceptive hiring practices—most notably ghost jobs—and restoring trust, transparency, and fairness to the U.S. job market. The Act establishes strict rules for how jobs may be advertised, how applicant data may be collected and used, and how employers, recruiters, and job platforms must conduct themselves throughout the hiring process.

At its core, the Act responds to widespread issues: companies posting jobs they do not intend to fill, perpetual “always hiring” ads, resume harvesting, and misuse of applicant data, including for marketing or AI training. The bill asserts that such practices distort labor-market data and harm applicants, and therefore require federal intervention. It empowers the Department of Labor (DOL) and Federal Trade Commission (FTC) to oversee enforcement and gives individuals the right to sue for violations.

Scope and Coverage
The Act applies to nearly every employer or recruiter who posts jobs viewable in the United States, regardless of location or platform. It also covers all entities involved in designing, administering, or distributing job postings.
